How is a visitation schedule determined?

Determining and maintaining child custody arrangements can be a big source of tension after a divorce, and issues related to visitation and child custody rights can often cause trouble for everyone involved. Whether you have shared or joint custody of a child, or if one parent has sole custody, you will still be operating off of a visitation schedule. This schedule is determined based on a number of factors, including but not limited to parental availability, history of abuse or neglect, status of employment, and ability to provide for the child.

In general, the courts will approve visitation schedules based on what they believe is in the best interest of the child. This can involve approving a plan that you have worked on and submitted with your ex-spouse, or making a ruling for you if you cannot come to agreeable terms.

However, changes can be made to custody arrangements and visitation agreements even after they have initially been finalized. If your situation or the situation of your ex-spouse has changed in any way, reevaluation may take place. Examples include getting a new job and having to move away, or being arrested or charged with crimes.
