What is legal separation?

48979056_S.jpgIf you and your marital partner are thinking about splitting up, you may have an array of options to choose from. For example, you may be able to work together and move forward with the collaborative process, or you may have to head to court and endure bitter disputes over family issues such as child support and custody. Sometimes, legal separation is an option for couples in Jackson County, and all across Missouri. However, it is vital to understand what legal separation entails and how it differs from a regular divorce.

According to the Missouri Courts, legal separation is very similar to divorce, but there is one major difference. When couples move forward with this option, they remain married at the time of the judgment, as opposed to a divorce, when the couple's marriage is dissolved. Couples may decide to opt for this route because of their insurance, religion or for other purposes. Like divorce, legal separation may result in rulings related to child support, child custody, the distribution of marital property and other matters.

Regardless of the decisions that you and your spouse make, it is vital to do everything you can to take a careful approach with divorce, legal separation or any other family law issues. If you have children, working toward a healthy outcome while aiming to reduce the amount of stress and uncertainty is particularly important.

This blog post was composed to offer insight on legal separation and is not to be viewed as an alternative to legal help.
